Weird, that codepen. Interesting.. Setting scale beyond 4 does not seem to increase the site of checkbox radio input any further, the target size prtobably remaining well below 44x22 - and what happens when clicking (at least on OS X) it is surely of a weirdness that no designer would want to use. But the point of the exception was not that it is not doable somehow (with overlays or whatever) but that the requirement to ensure target size for these elements would be onerous for those who put out a page with minimal styling (say, just font-size:2em on body) and want to use form controls.
