For clarity (as I think the original poster meant LOD Cloud Diagram):

 The LOD Cloud is the collection of Linked Data on the Web.
  As others said before, just publishing data on the Web is enough.

 The LOD Cloud diagram is a diagram that shows
   some of the datasets in the LOD Cloud.
   As you write, certain conditions need to be satisfied
   in order to be taken into consideration for this diagram.
   Also, the diagram is not always updated.

 Your dataset/ontology can also be in other indexes,
   such as Data Hub and LOV.
