Because the W3C Validator is a validator, and that document is valid.

http://validator.w3.org/docs/help.html#validation_basics

Some of the problems are conformance issues, but not validity issues.

http://validator.w3.org/docs/help.html#validandconform

Some of the problems are things that are both valid, and conforming but cause problems due to bugs in browsers.
