Unless I am missing something, your tests only checks if the header/footer are repeated in the simple case, not in what way they get dropped when there's not enough room, nor what constitutes enough room. As far as repeating the header/footer, both prince and AH formatters do repeat it, and Vivliostyle is working on doing it as well. I think the more complete description you had proposed in [1], with the tweaks I had suggested in [2] and which you seem to be ready to accept in [3] seem like a better approach that what you've now put in the spec. If you don't want to force this complex behavior on browsers just yet, I think we could still spec that as a should and allow what you currently have in the spec as a may.
