   The protocol doc should note that MERGE may fail due to 'the linear 
   constraint would be violated by the required creation of a working 
   resource'.

Good point.  Perhaps a good way to phrase this is that "the working
resources created by a MERGE request MUST NOT violate any of the
preconditions of a CHECKOUT operation".
