Yes, see my previous comments regarding script elements in XHTML.

Macromedia (who merged with Adobe recently and who came up with Flash
and Dreamweaver in the first place) are notoriously bad at producing
markup for inserting Flash content.

The problem is the script is HTML, not XHTML.
