Microdata in the spec (again)

Not sure how long this has been in the spec but I happened to look at
the nav element [1] today and noticed that the first example contained
microdata. There are several parts of the specification that contain
microdata (look for the itemprop, itemscope and itemtype attributes).

Wasn’t it agreed that the examples in the main HTML5 specification
should not contain this? Or is this just an error while trying to
merge WHATWG changes?
