I think this is an editorial issue. Section 5.1 states gives as one of four criteria for application conformance, "performs markup conformance testing according to all the conformance constraints appearing in this specification." This is the first time I find the phrases "markup conformance testing" and "conformance constraints" in the document. It's not clear to me exactly what these mean or how they differ from "stops processing when a fatal error is encountered" and "observes the mandatory conditions (must) set forth in this specification, and for any optional conditions (should and may) it chooses to observe, observes them in the way prescribed".
