The algorithm given in the draft preserves the children of included items, and if one of these items is an Unexpanded Entity Reference Info Item then it will appear in the result. I will add some text that makes it clear that Unexpanded Entity Reference Info Items and other arbitrary descendents are preserved. I also will note that Unexpanded Entity Reference Info Items are incompatible with XPointer and should result in an error. Thanks, Jonathan Marsh
