But it is surely not beyond the wit of a well-designed validator to identify the reason for the orphan and to report it, is it not ? Where the specification allows for implicit closure of an open element on encountering an element that would not be permitted within the scope of the open element (some would argue that this represents a major design error in the specification, but that is not relevant here), then a well-designed validator could usefully report why the apparently-open element had been closed if and only if an error results therefrom.
