massive w3c bug?

Hei W3C

This is my 3:rd email and i havent got ANY answers...not even that 
anyone even recived this mail.

I will continue sending this type of email until i get a respons from 
you,
either public or "privat" on following subject:

How can this code get thru W3C validation with 0 Errors (Valid 
code)???

I really thought W3C validator worked, but below code says diffrent.
