Bug 6151 occured again

Dear W3C team,

I tried to validate the document http://falktypo.ctwo.de/wetzel/ and 
corrected all errors except one:

/Line 1, Column 1/: end of document in prolog

|*<*!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional//EN"

|

Is it correct, that this issue's the same as *Bug 6151*? I hope this can 
easily be solved.
