<noscript> content?

I'm a poor hand at DTD's, but so far as I can tell, the <noscript> element can not contain #PCDATA directly; but the Validator is content with http://hades.mn.aptest.com/~megra/1_3-BF-01.htm.
 
Is this a case of pilot error or validator error?
