I appreciate the work that has gone into the validator. I find it quite helpful. When I include an XML declaration at the top of an XHTML document (as section 3.1.1 of the XHTML 1.0 spec strongly recommends), it sees the file as XML only and goes ka-blooey. If I remove the XML declaration, it validates the XHTML without errors. My apologies if this has already been brought up on this list.
