In the documentation for XHTML 1.0 it states that content-type text/html may be
used, so long as it adheres to Appendix C (Compatibility Guidelines). In
Appendix C.2 it states that minimized form of tags is to be used for all empty
elements.
The validation comes back as valid with closed empty elements.
