The opening html tag is optional in HTML 4.01:

I'm not sure about HTML 5, but in any case, http://validator.nu passes your
test case as valid too, which means that if this is an error, the bug should be
reported according to the validator.nu bug reporting instructions:
http://about.validator.nu/#reporting-bugs
