It's hard to check whether there is really a bug, if the issue you ran into is
not reproducible, and if you haven't kept a complete record of the error that
you got the first time. I suspect that the first time around, you used the
validator with some option (doctype override, perhaps) that triggered this
validation error.

I'll close this, please feel free to reopen if you can give a reproducible
process to check the bug.
