I know your note regarding Scrollbar Style and Validation at w3.org is an old one...BUT
If you cut and paste the source code to W3.org's scrollbars-test.html, it works! I believe your answer is in the initial html doctype source code for the scrollbars-test page:

<!doctype html public '-//W3C//DTD HTML 4.01//EN'
  'http://www.w3.org/TR/html4/strict.dtd'>

Evidently, 'doctype' reference matters more than most of us are aware.
