Your problem has the same cause as the bug described in http://lists.w3.org/Archives/Public/www-validator-css/2009Apr/0035.html You will notice different behaviour for http://jigsaw.w3.org/css-validator/ and for http://qa-dev.w3.org:8001/css-validator/ . You will notice different behaviour for three kinds of validation (URI, file upload, direct input). That makes six possibilities. The results are quite confusing. :-(
