CSS Validator and text/css

It looks like the CSS Validator doesn't complain on this page:
http://jomiller.com/css/fontsizetest.html

The CSS, while appropriately marked as text/css in the HTML document, is
returned as text/plain by the HTTP server. I believe that the CSS
Validator must not override the content type of the HTTP server and
generates an error if the content type for CSS files of not "text/css"
