<rdf:RDF> root element not needed

Validating this document fails:

The error message is: Error: Your document does not contain any RDF 
statement.

However, nesting this code in an <rdf:RDF xmlns:rdf="..."> element 
validates correctly. It was my impression that the rdf:RDF root element 
was not needed if it contained only one top-level child, according to 
the RDF/XML specification.

Have I misunderstood the specification? Or is there a bug in the validator?
