The scope of a declare is its surrounding math element -- not the entire document. It seems clear that being able to extend the scope to the entire document is helpful from a notational point of view, but this issue of larger scopes is one that is not unique to math, or declares and the working group has pulled back from a unilateral and possibly conflicting proposal on the issue. Also, there are numerous implementation issues that surface.
