It's been noted for nearly 3 years, see: http://www.w3.org/MarkUp/html4-updates/errata#entry-12 It's one of the most frequently reported HTML4 "errors" (not really an error, though). If you think there's an error in the spec, please report it to www-html-editor@w3.org so that editors can be aware of that.
