You're missing the extra wrinkle that in this case we're trying to determine if the change of both foreground and background colours does "count" as being more than just "use of color" (thus passing the SC). I'd say you'd likely want to check what the contrast ratio between the text in focused/unfocused state is, and the contrast ratio of the background in the focused/unfocused state. If one of these two is 3:1 or higher, that is the part that doesn't *just* rely on a change of colour, so use of color passes. Admittedly, once you have to start working out these more complex cases, it does sound (without having seen the thing you're looking at) like it's likely not that strong/sufficient a focus state to begin with...but I may be wrong.
