It seems to me to be a legal or policy decision but not a technical
requirement for conformance to WCAG 2.

The Conformance Requirements of WCAG 2 seem to address these topics only:
* Conformance Level 
* Full Pages
* Complete Process
* Accessibility Supported
* Non-Interference

I don't think this issue falls into any of the technical areas.
