Bruce (and others) as a follow-up to the DOJ’s rulemaking, I’m a little perplexed that in the DOJ’s comments on the rulemaking they assert that people can use equivalent facilitation to meet the technical requirements via WCAG 2.2 and not WCAG 2.1. That is – they either don’t understand the backwards compatibility of WCAG 2.x or that since they cited the 2018 version of WCAG 2.1 they are not accepting of the removal of SC 4.1.1 from WCAG 2.2 keeping backwards compatibility. The Department notes that this rule provides for equivalent facilitation in § 35.203, meaning public entities could choose to comply with this rule by conforming their web content to WCAG 2.2 Level AA because WCAG 2.2 Level AA provides substantially equivalent or greater accessibility and usability as compared to WCAG 2.1 Level AA.
