If the table just uses td and no other semantic markup like scope of headers/id, I guess we would pass the content but comment that layout tables are better avoided (or given role=presentation) since they add distracting SR output. Annoying output does not prevent access or use of content within the layout table. Flagging a 1.3.1 failure (especially as there is no WCAG Failure defined for it) seems too strong. However, we would watch out for failure of SC 1.3.2 "Meaningful sequence" if we see linearisation problems (forms laid out in tables).
