Scratch that. we do have a failure for CSS images that convey important
information ...

 hear Jonathan say that wai-aria doesn't change the situation for the
current failure, because it doesn't solve it for low vision users who turn
off background images... some have been proposing in different circles a
div with a label would be sufficient.
