Max, you traitor:) The mathml version of the stylesheet has had this fixed for a long time. (since mathml 1.1) The problem is with the stylesheet. (Actually HTML's content model for p is wrong, something (finally) addressed in XHTML2) Lists should logically be part of a paragraph, since logically they may be part of a sentence.
