purely presentational element

Hello,

I just took a glance of new beta.w3.org and noticed an element which
seems to be purely presentational element in a second:

<div id="w3c_logo_shadow" class="w3c_leftCol"><img alt=""
src="/2008/site/images/logo-shadow" height="32" width="100%"></div>

This can be a kind of separator, but I think it should not to be
marked up on the document, because it's presentational, rather than
content.

I think the image should be a background image of another element via
stylesheet.

Regards,
