Thanks @aboba. My read of your and @fippo's comments:
1. sw fallback is already not a given
2. but WebRTC already has workarounds in place

The workarounds are quirky for sure, but scalabilityMode doesn't make that worse. How do folks feel about those quirks? Are they bad enough to motivate deprecating getCapabilities()? (I'm not familiar enough to say).
