This is still pretty nonsensical, but I think https://github.com/w3c/browser-payment-api/issues/361 covers that nonsensicalness.

In particular, you're checking whether the _active document_ is allowed to use the feature, which doesn't necessarily have much to do with whether the document the constructor comes from is allowed to do so.
