Hi - we discussed in our plenary call [on 11-2](https://github.com/w3ctag/meetings/blob/gh-pages/2022/telcons/10-31-minutes.md#the-popup-api---leaverou-atanassov-1) - discussion includes some thoughts from @LeaVerou @atanassov and @plinss. Concerns center around what is and is not controlled by CSS and whether popup/popover should be the only way to place an element on the top-layer. Once you can control "top layered ness" as a CSS property, the use cases that prevent this from being an element are easily dealt with.
