So it seems this comes down to comment 8 which basically means enshrining an
architecture issue of a particular browser in the platform. In almost every
case where we have non-deterministic behavior we wish it was deterministic.
Should that not be here the case too? Even if that is half a decade away from
reality? The DOM Standard has called for Attr to no longer inherit from Node
for a while too, and that has not happened yet (nor has it been confirmed that
it can not happen).
