Yes, http://www.w3.org/TR/2004/REC-xml-20040204/ says:

> They are not part of the document's character data; an XML processor
> MAY, but need not, make it possible for an application to retrieve the
> text of comments.

Which means that *some* perfectly legal XML processors would not be
usable for REX as it is currently specified.
