Yes, I agree.  Although I think of Level 2 being higher (not lower) than Level 3.  Perhaps, “a more strict requirement than Level 3”?  I was comfortable with it at Level 1 also, but since 508 1194.22 dropped this requirement from WCAG 1.0, and we have been getting by without it, it is easy to argue that it is not essential.
