This question has important implications for technological innovation, as the answer will determine which technologies fall within the exclusive control of the copyright industries, and which are left to develop freely. This lecture will explore the rationale and scope of contributory and vicarious copyright infringement, the two copyright doctrines that are most often invoked against technology makers, and suggest solutions aimed at reconciling these indirect liability theories with the imperatives of technological innovation. His research focuses on the impact of peer-to-peer technologies on the future of copyright. He also continues to maintain a relationship with Morrison & Foerster LLP, where his practice is concentrated on transactions and counseling involving the Internet and intellectual property.
