Dear Advisory Committee representative, This is a W3C Patent Policy Call for Exclusions for the following Recommendation Track document: - Evaluation and Report Language (EARL) 1.0 Schema (http://www.w3.org/TR/EARL10-Schema/), exclusion opportunity ending on 26 June 2007 This specification was produced by the Evaluation and Repair Tools Working Group. If you do not wish to exclude patent claims during this exclusion opportunity, no further action is required. EARL 1.0 Schema was first published as a W3C Working Draft on 6 December 2002: http://www.w3.org/TR/2002/WD-EARL10-20021206/ At that time, the Working Group was not operating under the W3C Patent Policy. The Working Group began operating under the W3C Patent Policy with the 25 January 2005 Call for Participation: http://lists.w3.org/Archives/Member/w3c-ac-members/2005JanMar/0018 Per section 2 of the W3C Patent Policy Transition Procedure, there should have been an exclusion opportunity at that time for 90 days; see: http://www.w3.org/2004/02/05-pp-transition#switch However, due to a bug (recently discovered and repaired) in the system we use to implement the W3C Patent Policy, we did not send a Call for Exclusions at that time. I apologize for any inconvenience caused by the error. On 23 March, the Working Group published EARL 1.0 Schema as a Last Call Working Draft: http://www.w3.org/TR/2007/WD-EARL10-Schema-20070323 Ordinarily, this would have triggered a second exclusion period lasting 60 days (per section 4.1 of the Patent Policy [1]). Because we missed the initial 90-day exclusion opportunity, we are increasing this exclusion opportunity from 60 to 90 days. Participants thus have an opportunity until 26 June 2007 to exclude patent claims reading on the entire text of this Last Call draft. The extended exclusion opportunity is unlikely to affect the group's progress. Per this Patent Policy FAQ entry, please note that the group may advance to Candidate Recommendation during this exclusion period: http://www.w3.org/2003/12/22-pp-faq#mult-exclusions Excluded claims are not subject to the licensing requirements of the W3C Patent Policy for this document.
