In the interest of preventing further conversational meandering, I'd propose the following new ISSUEs and returning this thread to its original topic (May a third party represent that it is a first party?). 1) Should we consider outsourcing parties as first parties, third parties, or something else? 2) Should there be a special "operational use" exception for outsourcing parties, independent of any other "operational use" exception? 3) Should there be a special "unidentifiable data" exception for outsourcing parties, independent of any other "unidentifiable data" exception? I thought these three issues were long ago resolved as third parties; no; and no. But it appears that there's sufficient interest to revisit those conversations.
