Hi Laurent, Thank you very much for these links. IMO, the position "ML = TDM" is hardly refutable, and I share your reservations about the penultimate paragraph, that seems to move back from this assertion. I find also that the appreciation of Paul Keller about the Article 4 exception is a bit too optimistic. This opt out approach presents a weakness that we are precisely encountering: It is the responsibility of rights holders to prove that they have indeed expressed their reservations of rights, and therefore to impose a common protocol, accepted by all parties.
