What makes this issue slightly hairier than it first appears is that <meta charset> should be checked only for HTML5 documents, not any other HTML ones, so the doctype declaration needs to be parsed and taken into account as well. As noted in bug 5992 I have some alpha level code for this (for the validator, not HTML::Encoding) which I'll try to revisit today or later this week.
