Thanks for catching this. The only thing I found in UI event spec regarding this was: "If the event target (e.g. the target element) is removed from the DOM during the mouse events sequence, the remaining events of the sequence MUST NOT be fired on that element." It certainly doesn't seem very clear and isn't very specific particularly in examples like what you gave. I do think that UI events spec is a better place to have this definition though. i.e. what happens to the propagation path when some of the nodes are changing during the event dispatching.
