I actually had some discussion about this years ago with Murata-San;
they didn't want to specify or make visible how non-determinism was
resolved - i had asked because i was exploring what would be needed to
have rng as a possible alternative to xsd for XQuery/XPath/XSLT, hence
wanting to build XDM instances.
