If not, then as HTML5 currently stands, I think it may be better to have a note that says something like: "If you do not use language attributes on the html element, you should not have a <meta type=content-language content=*> element with a single language value for the content attribute. This is because HTML5 interprets this as setting the default language for the root element, but XML does not." or "If you have a <meta type=content-language content=*> element with a single language value for the content attribute, you must use language attributes on the html element. Otherwise HTML5 interprets this as setting the default language for the root element, but XML does not."
