[Bug 12072] Comments before <!DOCTYPE html> should be forbidden

However, the above warning is not 100% correct, as it dpeneds on the format of
the comment whether it brings IE in quirks-mode or not. See: 
http://bugzilla.validator.nu/show_bug.cgi?id=836

With regard to what HTML5 should say:: if comments before the DOCTYPE were
illegal, then validators could present a more unambigious error message. But on
the other side: it might be better if authors familiarize themselves with the
IE problems.
