Please let me know what the XPath working group's opinion is on this topic so that I can update the spec accordingly. Again, the only reason we added this text in the first place was to make XPath 1.0 compatible with HTML5, which I had expected to be desired by the working group; if such compatibility isn't desired, that's fine. (We have similar text to make HTML5 compatible with Selectors.)
