Dear Alexander, The goal of the W3C patent policy is to create royalty free standards unencumbered by patents. The W3C EXI working group and its members are operating under this policy [1]. None of the EXI working group members, which includes the holder of the patent you mentioned, have excluded any of their patents from this process (see [2]), so EXI will not be encumbered by this patent.
