Our resolution on https://github.com/w3c/csswg-drafts/issues/9740 does mean that you can now use the `:where(:scope)` selector to get the same behavior as root-`&` or bare declarations when scoped – without using any relative selectors. That requires authors to explicitly set up for scoping, but I think it might be an ok solution.
