We don't have consensus on that, but I don't think it should block your main question, which is:

> should we have a :modal-dialog pseudo-class or should we have a :top-layer pseudo-class[?]

How about adding a `modal` attribute to `<dialog>` and using an attribute selector to target it? At the moment there is an `open` attribute, but it shows in both modal and non-modal settings.
