BGSOUND error

I downloaded the following from Crescendo/LiveUpdate and get an error 
message on BGSOUND (<bgsound> isn't allowed in <object> statement) yet the 
code works fine.  I am using Tidy Build 290 Beta 10 to access Tidy.

Thought I'd pass it along.
